Innovations in the labor market test – applying for a permit for workers from abroad in Vietnam

There have been new regulations for employing foreigners in Vietnam since September 2023. A work permit is generally required for this. In order to receive a work permit, the employee must be able to be classified in one of the following categories: manager/executive, expert or technician – especially in positions that are based on technical or business qualifications. A work permit is valid for a maximum of 2 years and can be extended once. To the previously mentioned positions, those of head of a branch, representative office or place of business have been added. The point has been made easier that a connection between educational background and professional position is no longer necessary. However, relevant professional experience for the desired position must be proven.

Another innovation with regard to the labor market test is that, from January 1, 2024, the company must advertise a job advertisement through the portal of one of the national or provincial websites of the employment centers. These must be posted online at least 15 days before the foreign worker’s request, especially if there is a sponsorship. The job posting must include the position, job title and description, qualification requirements, experience, salary, duration, work location and contact details.

In summary, when filling new positions with foreign workers, please note the new requirements of the job advertisements and the associated labor market test in advance. Foreign work permits are issued solely by the Ministry of Labor, Invalids and Social Affairs in Vietnam.
