European regulation on the EU reporting portal

On November 13, 2024, the European Commission published a proposal for a European regulation on a common electronic form for reporting the posting of workers. The proposal provides for the creation of a multilingual electronic interface to the Internal Market Information System (IMI), which will be used for the central reporting of posted workers in freight transport. These notifications are currently managed independently by each Member State (via online portals, by post or by email).

If the regulation is adopted, it will be possible to create a common system for registering posted workers across the European Union. However, the regulation stipulates that participation is voluntary for EU member states. This means that EU member states are not obliged to participate in the central registration system for posted workers.

Due to the voluntary participation of the states, it remains to be seen whether this common system will really be popular. IAC Managing Director Kai Mütze: “In my opinion, this proposal comes far too late, as all European countries have already equipped themselves with their own system and have set up appropriate test scenarios and controls for the reports in these own systems.”
The aim of the regulation is to reduce the administrative burden on companies offering services within Europe.
